SUBJECT:  Canceling Open Security Deeds by Affidavit Pursuant to O.C.G.A. 44-14-3

Pursuant to O.C.G.A. 44-14-3, as amended July 1,1999, attached you will find a form affidavit for your use in canceling a security deed which you have paid. I am also attaching for your convenience a copy of the applicable section of the statute. The affidavit was created through efforts of the Georgia Real Estate Closing Attorneys Association (GRECCA), First American and other title companies. If properly filled out and recorded with all Exhibits attached, First American will allow you to eliminate the subject security deed from commitments and policies.
